MCHK Medical Assessor Nomination
Under section 20BB and 20BC of the Medical Registration Ordinance, subject to subsection (6), the MCHK Council may request a nominating authority to nominate a number of persons specified by the Council for appointment as medical assessors.
A person is eligible for nomination as a medical assessor only if the person—
(a) is a registered medical practitioner; and
(b) has the qualifications and experience required of a medical assessor
General provisions applicable to assessors (20BD of the Medical Registration Ordinance)
An assessor holds office for a period not exceeding 3 years. However, an assessor may, at any time, resign by giving notice in writing to the Chairman of MCHK .
In addition, the Council may declare an assessor’s office to be vacant if the assessor—
(a) is sentenced to a term of imprisonment for any offence;
(b) is the subject of an order made under section 21 or 21A;
(c) becomes bankrupt, or enters into a composition or arrangement with the
assessor’s creditors without paying them in full;
(d) is found by the Health Committee after due hearing to be incapacitated from carrying out the duties of the assessor’s office because of physical or mental illness;
(e) is no longer ordinarily resident in Hong Kong; or
(f) is, in the opinion of the Council, unable or unfit to perform the assessor’s duties and exercise the assessor’s powers.
Hong Kong Public Doctors’ Association is one of the nominating authorities specified in column 2 of Table 2 in Schedule 5.We shall nominate members of the Association (at the time of nomination) to MCHK for appointment as Medical Assessors. Pursuant to Section 20BC(6)(a) and (b), the number of medical assessors nominated by the Association and holding office at any time must be not less than 2 and not more than 10.
Under Section 58D of HKPDA constitution, all nomination of the Medical Assessors of the Association shall be decided by General Polling in a General Election at a General Meeting in every manner identical to the election of members of the Council and Office Bearers. Should there be no nomination for Medical Assessors of the Association, the vacancies shall be filled by the Council Members by secret ballot at a Council Meeting held within 14 days after the General Meeting. The Secretary of the Association shall prepare a medical assessor waiting list of 10 candidates who secured the next highest votes in the same election for the purpose of filling up any new vacancies as requested by MCHK from time to time. The waiting list will be decided at each General Election and shall stand valid until the next General Election.
